Thank you for your interest in The Pittsburgh Paints Co. (“PPC”) and learning more about our privacy practices. Our goal is “priming you for success”. Just as much as our paints are designed to protect your products and projects, we strive to protect the privacy of certain personal information that is collected about you.

Together with our Cookie Policy, this Privacy Statement applies to and describes how PPC and its affiliates use and protect your personal information that you may have provided to us through the use of our websites, applications, by other online media under our operation and control, or through HTML-formatted email addresses that we send to you that link to this Privacy Statement (referred to in this Statement as “Websites”, ”Apps”, ”Social Media” and collectively as “Sites”), when you apply for or accept a position with PPC, by phone or otherwise (together with Sites, our “Systems”).

This Statement is intended to apply to users in the United States and Canada interacting with PPC’s operations and Sites. However, for certain regions, products or services, specific privacy notices may apply instead of, or to complement this Statement. If you are outside of the United States and Canada, please follow the below guidance to contact PPC regarding any privacy matters.

Who Collects Your Personal Information
While we collect personal information through your access to or interaction with Our Systems,  you may provide personal information to third parties selling PPC products or benefiting from PPC services such as applications designed by our company. Such relationships are normally governed by a contract between PPC and its business partners, and PPC is not responsible for the personal information collection practices of such third parties. In this circumstance, please carefully read privacy statement of such third parties to whom you disclose your data.

Personal Information We Collect We may collect the following kinds of personal information depending on the context of collection.

  • Personal information we collect directly from you: (i) name, job title, country location, and date of birth (ii) contact information including home address, office address, alternative address (e.g., shipping), zip/postal code, phone number(s) and email address; (iii) areas of interest, including marketing contact preferences; and (iv) payment information including credit/debit card numbers, billing address or other payment information.

    We collect the above information, for example, when you (i) purchase our products and services; (ii) complete forms on our Sites; (iii) create a user account on our Websites  or within our apps; (iv) visit our manufacturing sites and/or offices; (v) participate in our promotions, offers, quizzes, questionnaires, and/or sweepstakes and contests; or (vi) provide us with feedback, leave a product review or contact PPC with questions or comments.
  • Personal information we collect via our Sites: (i) account information, including online identifiers such as username and encrypted password; (ii) IP address, device ID, device model; (iii) application usage patterns such as time or length of activity; (iv) browser information; (iv)geo-location data; (v) profile photos; (vi) public social media identifiers; and (vii) comments, reactions and opinion expressed in social media posts and/or product reviews posted on our Sites or about our products and services.

    We collect the above information, for example, when you (i) create a user account on our Website  and in our Apps; (ii) order and pay for PPC products and services; or (iii) make use of our Websites, Apps and interact with us via PPC’s Social Media accounts.
  • Personal information we collect via cookies and similar technologies: We and our partners use various technologies to collect and store information when you visit or use one of our Sites, and this may include using cookies, tracking pixels, beacons or similar technologies to identify your browser or device. Please consult our Cookie Policy to learn more about these technologies.
  • Personal information we collect about you from third parties: In some circumstances, we collect personal information about you from our business partners, from publicly available sources, or when you allow a third party to provide your personal information to us. Such information normally includes contact information (name, Social Media handle, e-mail address, phone number), job title and/or commercial interests. We then may combine such information with other information we collect directly from you, as described above.


Why We Collect Your Personal Information
The purposes for which we collect your personal information vary depending on the circumstances of collection. We may process your personal information for the following business and commercial purposes:

  • To provide you with products or services: We collect your personal information in order to provide you with products and services integral to perform our business relationship with you, including (i) creating your account; (ii) managing your orders, including payment; (iii) providing you with customer and technical services and/or product support; and (iv) responding to your questions, inquiries and concerns.
  • To facilitate your engagement with our Sites: We collect your personal information in order to manage your interaction with our Websites and Apps, including (i) activating your account; (ii) processing payments and fulfilling orders that you place on or through the Websites or Apps; (iii)allowing you to store  and/or delete photos or images that you submit, generate and/or save; and (iv) troubleshooting software issues, security and operational concerns that may arise. 
  • To interact with you on our Social Media sites: We collect your personal information in order to engage with you via our Social Media sites, including (i) administering our Social Media sites and enhancing your brand experience, on the terms and conditions set out by Social Media platform providers;(ii) informing you about our events, brands, products and services; and (ii) communicating with you via available functionalities within Social Media platforms (e.g., comments, in-site messages).  
  • To improve our products or services: We collect your personal information in order to generate valuable insights so that we can improve our product or services, including: (i) understanding your needs as our customer; (ii) customizing your user experience; (iii) measuring the effectiveness of communications and Websites and Apps performance; (iv) compiling market insights; and (v) conducting data analysis and testing on the Websites and Apps.
  • To promote our products and services: We collect your personal information in order to periodically reach out to you via different channels with promotional materials, including: (i) engaging in direct marketing by email, postal mail and phone; (ii) administering and processing surveys, quizzes, questionnaires and sweepstakes/contests; (iii) providing you with offers, samples, invitations to events, training courses; and (iv) providing you with advertisement information which we have a reason to believe you may find interesting based on your previous requests or based on similar products you have bought or expressed your interest before.   • To engage in Online Behavioral Advertisement: We may collect your personal information and other data which does not directly identify you to serve you interest-based advertising (“IBA”).   • To meet our legal obligations: We collect your personal information when the law requires us to do so, including (i)maintaining our business records; (ii) preventing fraud; (iii) complying with the requests of public authorities; (iv) complying with export control and sanctions regulations; and (v) abiding by health and safety laws and protocols.

We may also collector process your personal information for other purposes than those mentioned in this Statement, as otherwise described to you via in-time notice at or before the moment when we collect your information.

When we disclose your personal information and with whom
Except as noted herein, we do not sell or disclose your personal information with any person or entity outside of PPC.

We may disclose your personal information and other data with third parties as follows:

  • PPC business and administrative departments may be recipients of your personal information, so that we can benefit from our corporate structure to facilitate quicker and more efficient service to you by sharing within the group information systems, financial administration or other administrative tasks and customer service.
  • Processors and service providers are sometimes engaged by PPC to assist us with their services and may, in course of their engagement, receive, or otherwise have access to, your personal information. These processors and service providers include, but are not limited to: (i)media, design, printing, promotional, and event agencies in order to conduct promotional and marketing activities or execute communications on PPC's behalf;(ii) survey and market research companies, in order to obtain market intelligence; (iii) IT and other technical providers in order to obtain hosting, storage, or recovery services in case PPC's computer systems were ever damaged, destroyed, or inaccessible; (iv) shipping entities and logistics service providers (e.g., courier, postal services) to ship to you products and other materials on PPC's behalf; (v) payment processing and/or banking service providers; (vi) professional service providers, such as attorneys or accountants; (vii) customer services agencies for providing service to you where you ordered online; and (viii) job openings/candidate service providers.
  • In case of a legal requirement, PPC may also disclose your personal information and other data to relevant third parties if we are required to do so by law or that disclosing such information is necessary to:(i) conduct investigations of possible breaches of law; (ii) identify, contact, or bring legal action against someone who may be violating an agreement they have with PPC; or (iii) to avoid imminent physical harm to any person or to protect PPC's rights, safety, or property. We may also disclose your personal information to relevant third parties (e.g., forensics investigators, external legal counsel, law enforcement) to investigate, respond to, and/or to prevent a security/data incident, or to cooperate with government or law enforcement authorities pursuant to other legal matters.
  • In the course of corporate transactions, PPC may disclose your personal information and other data with a third party (and its attorneys, accountants and other relevant parties) in the event that PPC merges with, acquires, is acquired by, or becomes a legal affiliate with, such third party, or should such a transaction be proposed.
  • To fulfill the purpose for which you provide it or otherwise with your consent.
  • To enforce or apply our Terms of Use.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of PPC, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Security
The security of your personal information is important to PPC. PPC protects personal information by using, implementing, and maintaining industry standard physical, organizational and technological safeguards and security measures that are reasonably designed(appropriate to the sensitivity of such personal information) to help protect against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access to personal information when both in storage/rest and in transmission. PPC requires complex passwords for user accounts through the Websites and/or Apps.

IMPORTANT:  Please note that although we take reasonable steps to protect your information, no website, Internet transmission, computer system or wireless connection is completely secure.  Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our Sites. 

Retention Period
We will only keep your personal information for as long as it is required: (i) for the purpose(s) for which it was collected; (ii) to be retained by law; and/or (iii) to address any issues that may have arisen at a later date (in which case we will provide you with any further information as required bylaw).       
 
PPC reserves the right to maintain proper business records as required by law, or for otherwise legitimate business purposes to the extent permitted by law, even if such records contain your personal information.

Children’s Personal Information
The Sites are not intended for use by children. We do not intentionally gather personal data about visitors who are under the age of 18. If a child has provided us with personal data, a parent or guardian of that child may contact us to have the information deleted from our records. If you believe that we might have any information from a child under age 18, please contact us in accordance with the "How to Contact Us" section. If we learn that we have inadvertently collected the personal data of a child under 18 (or equivalent minimum age depending on jurisdiction), jurisdiction, we will take steps to delete the information as soon as possible.

Your Rights And Choices
We provide you with choices regarding the use of your personal information for marketing purposes. If you would like to opt out of receiving further promotional emails from PPC, please follow the opt-out instructions at the bottom of the email or submit a request to PPCLegalNotices@ppg.com.   Please note that if you have an account with us or you have purchased our products recently, we may still contact you with product, service, or safety related information.

Some local laws provide individuals with specific rights regarding their personal information. These may include a right to access, update, restrict, correct, delete/suppress, or object to use of personal information. If you wish to exercise any rights available to you under local law, please do so by submitting your request to PPCLegalNotices@ppg.com.  You may alsocomplete our Data Privacy Request Form. We respond to all request as soon as reasonably practicable and in accordance with applicable privacy laws.

California Residents

Other Specific States’ Privacy Rights 
State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information:
Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to: 

  • Confirm whether we process their personal information.
  • Access and delete certain personal information.
  • Correct inaccuracies in their personal information, taking into account the information's nature processing purpose (excluding Iowa and Utah).
  • Dataportability.
  • Opt-out of personal data processing for:

    • targeted advertising (excluding Iowa);
    • sales; or
    • profiling in furtherance of decisions that produce legal or similarly significant effects(excluding Iowa and Utah).
  • Either limit (opt-out of) or require consent to process sensitive personal data.

The exact scope of these rights may vary by state. To exercise any of these rights please email PPCLegalNotices@ppg.com stating in the email both your state of residency and your specific request in accordance with your applicable state law.

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may submit a request by sending an email to PPCLegalNotices@ppg.com. However, please know we do not currently sell data triggering that statute's opt-out requirements.

International Transfers
Due to geographical proximity of our business to our customers, we generally use and store your personal information within the United States and Canada, depending on your country of residence. However, PPC may in the future transfer your personal information to engage third party service providers based in countries outside of your country of residence. Since privacy law in those countries may not be as comprehensive as those in your country of residence, some regulations require PPC to take additional safeguards prior to the transfers and PPC is committed to comply with such laws, including, for example, implementing standard data protection clauses in these areas to ensure that PPC is meeting any jurisdictional requirements.

External Links
While on the Sites, you may choose to follow links to other external online locations, including those embedded in third party ads or sponsor information, which are not controlled by PPC. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you. The information they collect may be associated with your persona linformation or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.  You should consult the privacy policies of those respective third party sites for details before using them.

PPC may also allow interaction between the Sites and other sites or mobile applications such as Facebook or other social media platforms. This may include the "Like" button or other plugins available through the Sites that allow you to share information with persons outside of the Sites. Please consult the privacy policies of those third party providers before using them to make sure you are comfortable with the level of sharing.

Changes to this Privacy Statement
Both privacy laws and PPC business operations are extremely dynamic in nature. As a result, in the interest of transparency, we reserve the right to make changes to this Statement at any time as permitted by law. We suggest that you check back from time to time in order to understand how we treat your personal information. The Privacy Statement’s effective date will always be set forth at the top of the Privacy Statement. Any changes will be immediately incorporated into this Privacy Statement and will be prospective only. We will not make any changes that have retroactive effect unless legally required to do so.      
 
Your continued use of the Sites or interaction with PPC after any changes are made to this Privacy Statement constitutes your acceptance of the changes. If any changes are unacceptable to you, you should cease all use of the Sites or other interactions with PPC.
